Aspire-KP Roundtable of Legal Fraternity on the Issues of Merged Area

PESHAWAR: ASPIRE-KP convened a consultative roundtable on the legal, constitutional, and developmental challenges of the Merged Areas, engaging prominent members of the Khyber Pakhtunkhwa legal fraternity. Chaired by Mohammad Shehzad Arbab alongside senior advocates and jurists, the forum evaluated actionable legal strategies—including invoking the jurisdiction of superior courts—to enforce constitutional pledges made under the 25th Amendment, mandate the release of the 3% Federal Divisible Pool share, and expedite judicial integration across the former tribal belt.
  • Context & Core Focus: Serves as the specialized preparatory legal consultation stemming from the 29 September 2024 Symposium recommendations, specifically examining how the legal fraternity can act as a vehicle for post-merger constitutional accountability.

  • Key Deliberations:

    • Judicial Recourse under Constitutional Jurisdiction: Outlining the procedural and constitutional framework to approach the Peshawar High Court (and Supreme Court) under public-interest litigation to enforce the intent and spirit of the 25th Constitutional Amendment (2018).

    • Enforcing Financial Commitments: Formulating legal avenues to compel the federal government and non-contributing provinces to disburse the promised 3% Federal Divisible Pool (PKR 100 billion/year) allocation.

    • Rule of Law & Judicial Infrastructure: Identifying structural bottlenecks in extending regular lower judiciary infrastructure, replacing informal/colonial-era justice vestiges, and strengthening law enforcement coordination across merged districts.

  • Strategic Outcome: Laid the foundation for the joint legal-political petition framework formalized during the broader 24 December 2024 multi-stakeholder roundtable.
